The average time it takes to get a divorce in Ontario is 3 months. Its always better to file early because Covid-19 has caused serious delays and the courts are backed up. There is no way to obtain a divorce quicker, the courts do not speed up the process. 

To obtain a divorce, you and your partner must be separated for at least 1 year. Separation does not have to be physical. You can both reside at the same location and still be separated, especially when there is no chance for reconciliation. 

You do not need to wait for a year to file for divorce, you can file for a divorce at any time, the court will not provide the divorce until 1 year has passed since the date of separation.  

The cost of a divorce in Ontario depends on which type of divorce you need. The cheapest and most effective method is a “Joint Divorce”. This is when you and your partner both apply together. A joint divorce will also allow you hire the same lawyer and sign a joint retainer. The cost of a uncontested divorce is usually between 850-1000 dollars. There is also a $632.00 court fee which must be paid. If an individual makes under 32,000 and can provide proof through there notice of assessment, they will only need to pay $10.00. 

If you and your spouse have children, property, or other assets, you can opt for a separation agreement. A Separation agreement will allow you work together and reach an agreement that works for both of you. Can I get divorced in Canada if I was married outside of Canada?

Yes, you can. If you have been residing in Ontario for at least 1 year, you can file for divorce. Where you were married does not determine where you get divorced. You or your spouse must be residing in Ontario for at least one year before you can commence divorce proceedings.
